The Speaker laid before the House a message from the President transmitting a notification stating that the emergency declared with respect to significant narcotics traffickers centered in Colombia is to continue in effect beyond October 21, 2007 - referred to the Committee on Foreign Affairs and ordered to be printed (H. Doc. 110-65).

The House received a communication from Greg Lankler, Staff Assistant, Office of Rep. Obey. Pursuant to Rule VIII of the Rules of the House of Represenatives, Mr. Lankler notified the House that he had been served with a grand jury subpoena issued by the U.S. District Court for the Central District of California and that after consultation with the Office of General Counsel, he had determined that the ad testificandum aspect of that subpoena was not consistent with the rights and privileges of the House and the duces tecum aspect of the subpoena sought records that were not material and relevant.

Ms. Woolsey asked unanimous consent that business in order under the Calendar Wednesday rule be dispensed with on Oct. 24. Agreed to without objection.

The Chair announced that the message and the accompanying bill would be referred to the Committees on Energy and Commerce and Ways and Means and that the Clerk would be directed to notify the Senate of the actions of the House.

On passage, the objections of the President to the contrary notwithstanding Failed by the Yeas and Nays: (2/3 required): 273 - 156 (Roll no. 982).

WORDS TAKEN DOWN - During the course of debate, exception was taken to certain words used in debate. The Chair ruled that the words did not breach the rules of decorum and were in order. The House resumed debate on H.R. 976.
