ADJUSTMENT OF WHOLE HOUSE - under Clause 5(d) of Rule XX, the Chair announced to the House that, in light of the administration of the Oath of Office to the Gentlewoman from Massachusetts, the whole number of the House is 433.

OATH OF OFFICE - Representative-Elect Nicola Tsongas, Fifth District, State of Massachusetts, presented herself in the well of the House for the purpose of taking the Oath of Office which was administered by the Speaker of the House.

The House received a message from the Clerk. The Clerk transmitted the House a scanned copy of a Certificate of Election recieved from the Honorable William Francis Galvin, Secretary of the Commonwealth of Massachusetts, indicating that, at the Special Election held on October 16, 2007, the Honorable Nicola S. Tsongas was elected Representative to Congress for the Fifth Congressional District, Massachusetts.

On approving the Journal Agreed to by the Yeas and Nays: 219 - 187, 2 Present (Roll no. 981).

UNFINISHED BUSINESS - The Chair announced that the unfinished business was the question of agreeing to the Speaker's approval of the Journal, on which the Yeas and Nays had been ordered earlier and on which further proceedings had been postponed.

PLEDGE OF ALLEGIANCE - The Chair designated Mr. Murphy, Tim of PA to lead the Members in reciting the Pledge of Allegiance to the Flag.

POSTPONED PROCEEDINGS ON APPROVAL OF THE JOURNAL - The Chair announced that she had examined the Journal of the last day's proceedings and had approved it. Mr. McNulty demanded that the question be put on agreeing to the approval of the Journal and by voice vote, the Chair announced that the ayes had prevailed. Mr. McNulty demanded the Yeas and Nays which were ordered. Subsequently, pursuant to the rule, the Chair postponed further proceedings on the question of agreeing to the approval of the Journal until later in the legislative day.
